Kerala Court imposes fine on hospital for selling drugs from its pharmacy without licence

Chennai, 22 Dec: The Judicial First Class Magistrate Court at Nedumangadu in Thriuvananthapuram district imposed a fine of Rs.24,000 on the owner cum doctor of a private hospital at Venjaramoodu for violation of section 18 (c), Rule 65 (17) and Rule 65 (2) (3) of the Drugs & Cosmetics (D&C) Act and Rules.

Karnataka Drugs Control Department to recruit 100 new drug inspectors

Mumbai, 12 Dec: Karnataka Drugs Control Department has requested the Ministry of Health and Family Welfare, (MoHFW) Government of India, to sanction the appointment of 100 new drug inspectors within the state. The approval for the same is expected within the next two to three days. The full fledged procedure is likely to be completed in next three months.

New drug policy to cut cap prices of 650 common drugs

MUMBAI, 9 DEC: Prices of 652 commonly used medicines under 27 therapeutic areas are likely to come down by 10-15% once the National Pharmaceutical Pricing Policy 2012 is notified, which is expected in a few days. The policy, which caps prices of essential drugs, was finalized recently after several twists and turns over the years. It will cover a wide range of drugs, such as anti-infectives (Cetrizine), cardiac (Aten) and gastro-intestinal medicines (Ocid), pain-killers (Paracetamol) and anti-diabetic drugs (insulin).

Govt issues National Pharmaceuticals Pricing Policy, 2012

Mumbai, 10 Dec: The Central government issued the National Pharmaceuticals Pricing Policy, 2012 (NPPP-2012) to put in place a regulatory framework for pricing of drugs so as to ensure availability of required medicines – “essential medicines” – at reasonable prices. The policy provides for sufficient opportunity for innovation and competition to support the growth of industry, thereby meeting the goals of employment and shared economic well being for all.

MUMBAI, 27 NOV: The hearing on the revised drug policy in the Supreme Court has been deferred to December. Since the proposed policy has not been notified, the Government has sought more time, a source familiar with the case told Business Line. The hearing will now come up on December 12. The apex court hearing is crucial as the drug policy discussions gained traction under its watch.

PPA's attempts to recover overcharged amounts through district collectors

New Delhi, 22 Nov: The recovery of arrears by the National Pharmaceutical Pricing Authority (NPPA) from the overcharging pharma companies continued to be very slow, even after pursuing the matter through district collectors, thanks to the long-pending cases in the cases. As per the latest records by the agency, notices were sent in 885 cases of overcharging till October 31 this year, for a total amount of Rs.2577.28 crore while the recovered amount stood at just Rs.232.51 crore so far.

Untested Insulin, vaccine vials on sale in medical shops

Kochi, 4 Nov: In a major revelation of the precarious state of health care system in the state, the insulin vials and vaccines for children is found to be on sale without being subjected to necessary quality checks. Lack of a proper machinery to conduct quality check in the state drugs control department is cited as the reason for this negligence. The revelation is made by the drugs control division of the state in its reply to a query sought through RTI on standards of quality of drugs sold in the state. Most of the machines used for the quality checks at the testing lab of the state drugs control department in Thiruvananthapuram has long since become dysfunctional. There is also an acute shortage of equipment for conducting basic quality tests.

नशा, इलाके में कितनी गहरी जड़ जमा चुका है, इसका अंदाजा इसी बात से लगाया जा सकता है कि एक अकेली दुकान में तीन महीने के दौरान दो करोड़ नशे की गोलियों की आपूर्ति हुई। नशे की गोलियों की इतनी बड़ी खेप कहां खपाई गई, इस सवाल का जवाब औषधि विभाग दो दिन की मगजमारी के बाद भी नहीं ढूंढ पाया। आरोपी अभी भी पुलिस से दूर है। फिलहाल मामले को लेकर सस्पेंस बरकरार है।

मेरोपेनम लगे 68 मरीजों की हुई एमजीएच में मौत

जोधपुर.शहर में नकली मेरोपेनम इंजेक्शन का कारोबार अक्टूबर 2010 में शुरू हुआ था। इस मामले के खुलासे के बावजूद अब तक यह स्पष्ट नहीं हो सका है कि आखिरकार कितने लोग नकली इंजेक्शन की वजह से मौत का ग्रास बने। पुलिस की मांग पर एमजीएच के खंगाले गए रिकॉर्ड में सामने आया है कि इस अवधि में अस्पताल में कुल 392 मरीजों को मेरोपेनम इंजेक्शन लगे। इनमें से 68 मरीजों की मौत हुई थी। इनमें पांच मरीज बीपीएल श्रेणी के थे, जिन्होंने उपचार के दौरान दम तोड़ा था।

Health ministry finalizing rules to curb indiscriminate use of antibiotics by adding Schedule H1

New Delhi , 3 Sept: Following the reports of indiscriminate use of antibiotics leading to cases of microbial resistance and resultant health hazards, the health ministry is finalizing the rules under Schedule H1 to control the use of antibiotics and is planning to notify them officially very soon. The draft rules to amend the Drugs and Cosmetic Rules were already published and the feedbacks were being examined for finalization of the same, sources said, adding that final notification would be done after getting them vetted by the Law Ministry.

DCGI directs state DCs to strengthen regulatory control at retail outlets to ensure dispensing of drugs as per D&C Rules

Mumbai, 5 Sept: The Drugs Controller General of India (DCGI) Dr GN Singh has directed the state drugs controllers to further strengthen the regulatory control at retail sale outlets in the country to ensure that drugs are dispensed by the retail chemists in compliance to the provisions of Drugs and Cosmetics Rules. Concerned over the growing violations of Rules by the chemists and druggists across the country, Dr Singh asked all the state drug controllers in the country to direct the Drug Inspectors to make surprise inspections of chemist shops in their respective jurisdictions to ensure that the conditions of licences are complied with. "The Chemist and Druggist Associations in your States may also be sensitized to ask their members to comply with the provisions of the Drugs and Cosmetics Rules to avoid action under the Drugs and Cosmetics Act for the violations of the provisions of the Drugs and Cosmetics Act and Rules made thereunder", the DCGI in his directive said.

APDCA contemplating legal action against Alkem, Celon and Seven Pharma for illegal misbranding activity

Hyderabad, 29 Aug: The Andhra Pradesh Drug Control Administration (APDCA), which had seized drugs worth Rs.45 lakhs from Alkem Laboratories for illegally involved in changing the labels of its brand from ALCLAV-625 to ALCLAV-FC, is contemplating legal action on all the involved parties which include Alkem Laboratories Ltd, Daman, Celon Laboratories, Hyderabad and Seven Pharma Ltd, Peru. Earlier in April 2012, the APDCA had seized drugs worth Rs.45 lakhs (250,000 numbers of ALCLAV-625 tablets) from Alkem Laboratories Ltd for diverting its export consignment - meant for its distributor Seven Pharma in Peru - to Hyderabad’s Celon Laboratories and illegally changing labels of its original brand name on the strips from ALCLAV-625 to ALCLAV-FC.

DCC to examine the issue of stocking and dispensing of medicines by doctors

Mumbai, 28 Aug: The Drug Consultative Committee (DCC) will soon examine the provisions listed under Schedule K of the Drugs and Cosmetics (D&C) Act, with a view to control the practise of registered medical practitioners engaged in stocking and dispensing of medicines directly to the patients without licence. This move comes in the wake of increased incidence wherein doctors were found violating the provisions of the D&C Act by running parallel pharmacies to sell the drugs.

Maharahstra, TN account for 36% of sub-standard drugs

NEW DELHI, 22 AUG: Almost one in three drugs (36%) found "not of standard quality" from across India last year were from Maharashtra (23%) and Tamil Nadu (13%) alone. Around 9.2% of the rest of the sub-standard quality drugs were from Kerala, Gujarat (8.5%), Karnataka (7.2%), Uttar Pradesh (6.9%), Jammu & Kashmir (6.08%) and Rajasthan (5.8%).

Heat on doctors taking pharma sops

NEW DELHI, 18 AUG: The government is all set to crack the whip on doctors found prescribing medicines of drug companies, in return of gifts or favours. Union health minister Ghulam Nabi Azad said on Friday that the ministry has received several complaints on this unholy nexus, and the matter has been referred to the Medical Council of India (MCI). According to the MCI, it received 702 such complaints in 2011-12 of which 343 have been referred to state medical councils.

Maharashtra FDA to set up 3 new drug testing labs at Thane, Nagpur and Pune at a cost of Rs.900-cr

Mumbai, 14 Aug: The Maharashtra Food Drugs and Administration (FDA) will establish three new drug testing laboratories at Thane, Nagpur and Pune to test the quality standards of the pharmaceutical and food products manufactured in the state. The total cost of establishing these laboratories is estimated at Rs.900 crore. Currently FDA has only two drug testing laboratories one at Mumbai and another at Aurangabad. Sources from FDA said that the drug testing laboratory located at Mumbai is the National Accreditation Board for Testing and Calibration Laboratories (NABL) and has a capacity to conduct 8000 sample tests per annum.

Recovery in overcharging cases picks up as NPPA sends more notices

New Delhi, 11 Aug: The National Pharmaceutical Pricing Authority (NPPA) has issued notices on the grounds of overcharging in 847 cases so far to claim a total amount of Rs. 2462.83 crore, showing an upward trend in the number of fresh cases and recovery in the recent past. During the last five months till the end of July, the price monitoring agency sent notices in 31 cases to recover an amount of Rs.5.93 crore. During the last one year time, it sent 35 cases.

Mumbai, 9 Aug: Every year 3.2% of Indians fall below the poverty line because of high medical bills. This was revealed by the World Health Organisation (WHO). It states that almost 70% of Indians spend their entire income on health care and purchasing medicines. Medicines, which comprise 15% to 75% of the total health care costs, are a key concern due to the vast difference in pricing between brands of the same medicine and the low awareness among consumers. Consider this.Two brands of similar sized ready-to-cook noodle pack costs Rs10. Different brands of 200 ml mango juice sell at the same rate of Rs12. But the price difference between brands of an antibiotic of the same composition can be as wide as Rs60 or even a whopping Rs6,800 when it comes to brands of the same cancer medicine.

HIV Infections Declined by 56% During the Last Decade in India

New Delhi, 13 Aug (PIB): HIV infections have declined by 56% during the last decade from 2.7 lakh in 2000 to 1.2 lakh in 2009 in our country. This was stated by Shri Ghulam Nabi Azad, Minister of Health and Family Welfare at the International HIV Vaccine Symposium in New Delhi today. Addressing the inaugural ceremony, Shri Azad said that HIV was detected in India over 25 years ago. Valuable knowledge and experience has been accumulated as a result of extensive interventions for control of the epidemic and it seems to be stabilizing now. India is among the few countries which have made significant reductions in HIV infections.

Drug watchdog to target misbranding pharmas

New Delhi, 7 Aug: The drug watchdog, National Pharmaceutical Pricing Authority (NPPA), is planning to send notices to the state drug controllers against firms that often take out price-controlled active ingredients from their popular formulations but retain the brand name. “We cannot approach the companies directly as drug ingredients and approval is not under our mandate. We will send notices to the Drug Controller General of India (DCGI) and state drug controllers who have the authority to look into the quality of medicines,” said a senior official at the NPPA. “We are mulling over hiring field staff to collect drug samples from the local medical stores to check if the ingredients have been tweaked without informing us.”

High Court stays food safety and standards regulations

BANGALORE, 27 JULY: The Karnataka High Court on Thursday stayed for three months the implementation of the regulations and some of the provisions of the Food Safety and Standards (FSS) Act, 2006, which were enforced from August last year. Justice Mohan Shantanagoundar passed the interim order after hearing the petition filed by the Karnataka Pradesh Hotels and Restaurants’ Association.

Five states sign joint declaration to provide essential drugs free to all patients coming to govt hospitals

Chennai, 27 July: The medical supply corporations of Tamil Nadu, Kerala, Karnataka, Gujarat and Rajasthan have decided to work jointly to bring down the out of pocket expenditure on medicines and make free supply of essential drugs to all the patients coming to the government hospitals. A decision to this effect was taken at a meeting of CEOs of the medical supply corporations of these states held at Thiruvananthapuram recently in which SC Pant, managing director of the Central Medical Store Organisation of Gujarat, K Ananadan, general manager, TN Medical Services Corporation, M Shivarudraswamy, chief drugs supervisor, Karnataka Drug Logistics and Warehousing Society, Dr. Samit Sharma, MD, Rajasthan Medical Services Corporation and Biju Prabhakar, MD, KMSCL were present.

NPPA turns down pharma firms' request for hike in insulin price

New delhi, 27 July: Pharmaceutical companies, including Eli Lilly, Cadila, Lupin and Biocon, will have to continue selling insulin at the current price, as the drug price regulator National Pharmaceutical Pricing Authority (NPPA) has turned down their request for a rate increase. Instead, it has slashed the prices of Vitamin C-based medicines and multi-vitamins by 0.12-37.76 per cent. Drug makers like GlaxoSmithKline, Piramal and Pfizer, leaders in the segment, are likely to be affected by the move. However, the regulator has allowed an increase in prices of Merck’s Vitamin E-based drugs and a few antibiotics and antibacterials from Alkem and Alembic.

Drug authorities in AP seize drugs worth Rs.1.5 lakh from an illegal clinic in Medak district

The Andhra Pradesh Drug Control Authorities (APDCA) have seized drugs worth Rs.1.5 lakhs from a self proclaimed RMP (Registered Medical Practitioner) doctor running Mamidyal first Aid Clinic in Mulugu mandal of Medak district in the state. Close on the heels of its action on Gaba Pharmaceuticals just last week in Hyderabad, the DCA authorities are continuing their inspections on the defaulting drug manufacturers and their distributors in the state. Recently, the state drug authorities have unearthed one more illegal medical drugs racket in Medak district of Andhra Pradesh where in illegal drugs worth Rs.1.5 lakhs have been seized by the authorities.

Food supplements makers in TN to move court seeking amendment to FSSA rules

Chennai, 24 July: Technical and legal hurdles in obtaining product approval certificates, which are mandatory for getting the new FSSA licence, are forcing the newly formed Tamil Nadu Food Supplement Manufacturers and Traders Association (TFSMTA) to launch a legal battle over the issue, it is learnt. According to Thomas Philip, the advisor of the Association and the managing director of Stamin Millennium Nutraceuticals, the stringent norms in the Food Safety and Standard Act (FSSA) 2006 obstructs the growth of the industry and creates problems to the manufacturers. He argues that there is no need of product approvals and the provision should be quashed.

NPPA revises prices of 154 formulation packs

New Delhi, 25 July: The National Pharmaceutical Pricing Authority (NPPA) revised the prices in respect of 154 formulation packs based on bulk drugs including of vitamin C, vitamin E, chlorpromazine, multivitamin, and monocomponent human insulin. As per the notification by the NPPA dated July 19, other formulations packs whose prices were revised are based on bulk drugs like aspirin, cefotaxime, chlorpromazine, vitamine E (Tocopheryl), streptomycin with penicillin, norfloxacin, sulphadoxine, dexamethasone, metronidazole, prednisolone, and monocomponent human insulin.

Maha FDA prohibits Mankind from selling, distributing drugs worth Rs.2 cr until further notice

Mumbai, 24 July: The Maharashtra Food and Drugs Administration (FDA)-Pune division issued a notice to Mankind Pharma, prohibiting them from selling and distributing drugs worth Rs.2 crore in the state until further notice. The notice was issued to the company for not complying to the storage conditions as required under the Drugs and Cosmetics (D&C) Act while storing their drugs in the godown of Sheetal Distributors in Pune. During the initial investigation that was carried out last month, the FDA officials found the company to be flouting the rules and provisions listed under D&C Act 1940 and rules 1945, thus prompting the officials to seize, Mankind's drugs worth Rs.2 crore, for improper storage of goods.

Karnataka drugs control officers track down unlicensed IV set production unit, seize IV sets worth Rs.2 cr

Karnataka drugs control department has unearthed an unlicensed manufacturing unit of Sangam Health Care Products Ltd at Gulbarga in the northern part of the state engaged in the production of Intravenous (IV) infusion sets. Gujarat FDCA seizes drugs worth Rs.89 lakh from dealer of Redix Life Care in Ahmedabad

The Gujarat Food and Drug Control Administration (FDCA) recently carried out a raid and seized drugs worth Rs.89 lakh from the godown of an unlicensed dealer of Redix Life Care for stocking medicines without a valid license. Following the raid, carried out in Sarkej, Ahmedabad, the officials have collected 12 samples of the drugs from the site and have sent them for testing and analysis to the food and drugs laboratory at Vadodara.

Kerala DCA registers cases of violation of DPCO against retail shop; seizes drugs worth over Rs.6 lakh

The Ernakulam zone of the Kerala drugs control administration has registered cases of violation of DPCO of National Pharmaceutical Pricing Authority (NPPA) for overcharging against a retail pharma shop in the city and reported it to the national authority. According to assistant drugs controller (ADC) Pradeep Kumar, Alpha Drug House on T D Road was selling the drug Nircip 500 mg tab, containing ciprofloxacin HCL 500 mg with an MRP of Rs.80 for 10 tablets, instead of Rs.60 fixed by the NPPA. The inspectors prevented the sales of this drug, which comes around 5740x10 tabs, worth around Rs.4.5 lakh.

Karnataka drugs control dept tracks down sales of psychotropic substances without prescription

Karnataka drugs control department has tracked down at least 100 out of the 450 chemists and druggists selling psychotropic drugs without a prescription in several districts of the state. The department carried out a special drive from July 6-8, 2012 to verify if the pharmacy outlets were adhering to Schedule H of the Drugs and Cosmetics Act (D&C) which calls to  dispense drugs only with a valid prescription. The inspection was carried out by officials as a part of the department's surprise audit.

Trade bodies urge Maha govt to curb dispensing of medicines by doctors

Pharma trade associations from Maharashtra has approached the state government requesting them to formulate guidelines to ensure stronger policing of the drug distribution system in the state to restrict doctors from indulging in unethical practice of distribution of medicines to the patients directly. This demand comes in the wake of increased incidents of doctors selling drugs to the patients by misinterpreting the provisions under schedule K (5) of the drugs and cosmetics (D&C) Act. Schedule K (5) from the Act deals with provisions regarding drugs supplied by the registered medical practitioners to the patients directly. It allows the doctors to dispense medicines in their clinics under certain conditions. However, doctors are found to be flouting the rules by dispensing the medicines indiscriminately, at times, even charging a higher price.

Even though the Bombay High Court has vacated the stay on publishing the results of the interviews conducted by the Union Public Service Commission (UPSC) in March this year for the post of Deputy Drug Controller General of India (Dy DCGI), the issue is not out of legal tangle as another case related to the issue is pending in Madras High Court. According to sources, the Madras High Court has already served notice to the government on the petition. But, the case is yet to come up for hearing as the government is yet to file the counter affidavit.

Cough syrups sale comes under scanner

KOCHI, 12 JULY: The Drugs Controller's office is going to act tough on the sale of cough syrups. Strict action will be taken against medical shops which sell these syrups without prescription and help in their misuse, said the assistant drugs controller. Corex, Phensedyl, Tossex, Linctus and Codeine compound are some of the cough syrups which are being used as sedatives. This abuse is rampant which has made the Drugs Controller's office to take steps to prevent the problem. The sale of drugs like Alprazolam, Spasmoproxyvon, Nitrazepam, Kaverta, Penegra and Fortwin has also come under the scanner. It has been found that many medical shops sell these drugs without prescription and without giving bills, said the assistant drugs controller. The licence of such shops would be cancelled if they were found to flout rules, he said. All medical shops should keep the registers of all drugs and it should be brought before the drugs inspector when necessary, he said.

Karnataka drugs control department functions in an environment of transparency and efficiency. Today, the department is manned by 51 inspectors, 38 assistant drugs controllers, 8 deputy drugs controllers and one additional drugs controller. But holding the mantle of the state drugs regulatory authority is Dr. B R Jagashetty, who has driven the need for   computerization, speedy clearances of manufacturing - pharmacy trade licenses, disbursing of quick test reports and ensuring streamlined operations across the offices located across the state. In an interaction with Nandita Vijay, Dr. Jagashetty indicates the issues and the future focus areas of the drugs control department, Excerpts: As the Karnataka drugs controller, member of the DTAB and chairman of Committee on the Amendment of the Drugs & Cosmetics Rules, how do you react to the current controversies embroiling on the DCGI appointment? I would refrain from commenting on these issues as they do not come under my purview. Do you feel that the selection process was transparent and do you feel full justice was done to the Recruitment Rules? Maha FDA issues notice to Cipla for not complying to storage conditions

The Maharashtra Food and Drugs Administration (FDA)-Pune division, recently issued a show-cause notice to Cipla demanding explanation from the drug major as to why they were not complying to the storage conditions as required under the Drugs and Cosmetics (D&C) Act to store drugs in their Pune Western warehousing compound. B R Masal, joint commissioner (drugs), FDA, Pune division said that following a visit to Cipla's warehouse, it was found that the company was flouting the rules by storing the goods improperly. Eighty one samples were taken from the site and sent to the government laboratory in Mumbai for analysis. The surprise visit to the Cipla’s warehouse was carried out by FDA Pune after receiving a complaint by Narendra Jain, national convener of Pharma Gladiator (India) in public interest on May 16.

In a representation to union health minister Gulam Nabi Azad, AIDCOC secretary general Ravi Uday Bhaskar said that the government had promised capping of prices of all essential drugs under NLEM in the pharmaceutical policy 2012, but it has not taken any concrete step towards fulfilling it. He also wanted the ministry to rationalise the difference between the ex-factory price and the MRP of the medicines as the profit margins are exceeding more than 1000 per cent on some of the formulations.

State to urge Centre to ban high alcohol content drugs

BHUBANESWAR, 9 JULY: In view of the drugs-hooch mix tragedy early this year in the State, the Government on Monday took a tough stand on preparation and sale of drugs having high alcohol components and urged the Centre to ban such drugs. "It has been decided that the Central Government will be requested to prohibit drugs with high percentage of alcohol," said Chief Secretary Bijay Kumar Patnaik after a high-level coordination meeting on checking hooch tragedy and sale of contaminated drugs. Meanwhile, the Drugs Controller has banned the production of such contaminated drugs in the State. Eight pharmaceutical companies manufacturing drugs with high alcohol content have been banned from production and sale of these drugs.

Drug controllers of 10 states follow Gujarat model

AHMEDABAD, 9 JULY: Ten states across the country are keen to adopt Gujarat's model for speed and transparency in the pharmaceutical industry. The Food and Drugs Control Authority (FDCA)'s unique software- Extended Laboratory Node-is being shared with states like Maharashtra, Karnataka, West Bengal, Kerala, Andhra Pradesh, Goa, Himachal Pradesh, Madhya Pradesh, among others, for free. The Gujarat FDCA is the first state in the country to adopt this software for making all its applications and services online. This software helps FDCA bring all the information relating to retailers and wholesalers from the state under the preview of public domain. FDCA issues online product licenses in the bulk drug segment through this software apart from using it for other initiatives.

AIIMS store under cloud for changing drugs

NEW DELHI, 4 JULY: The AIIMS medicine store which claims to be giving medicines on 56% discount has come under scanner for allegedly substituting the medicines prescribed by doctors with other drugs to make more profit. The 24X7 store allegedly provides discount on generic versions with print rate almost as high as the branded ones. For example, a lesser known generic version of sulbactum and cefoperazone (2g) - antibiotic for serious infections - is priced at Rs 525 (before the discount) while the company which owns research molecule sells it for Rs 598 without the discount. Several other generic drugs with the same molecule are available in the market for less than Rs 250 (minus the discount) only.

21 docs violated abortion drug norms: FDA

Kolhapur, 6 July: The Food and Drug Administration (FDA) here has found irregularities in abortion drug stocks with 21 gynaecologists in the district. FDA assistant commissioner NA Yadav informed the civil surgeon, LM Patil, about the irregularities. As per the provisions, the doctors have to maintain receipts of medicines purchased, details of patients to whom the medicines have been given. Recording the medicine batch number is mandatory. These 21 gynaecologists have not maintained the records.
